Artist Member License and Release
Welcome to American Women Artists (“AWA,” “we,” or “our”)! AWA is a nonprofit, 501(c)(3) tax-exempt organization dedicated to the inspiration, celebration, and encouragement of women in the visual fine arts. We are a membership organization made up of women artists, patrons, and gallery owners throughout the US and Canada. By joining AWA as an artist member, and/or by clicking a button or checking a box on our website marked “I Agree to the Artist Member License and Release” [or similar language, you signify that you have read, understood, and agree to the following terms:
1. You may choose to submit your artwork, or images of your artwork (“Submitted Work”), to AWA from time to time. You hereby grant AWA the right to take, use, publish, reproduce, display, and distribute (collectively, “Use”) all Submitted Work, for all lawful purposes in furtherance of AWA’s mission. Submitted Work shall include but is not limited to: (i) images, reproductions or excerpts of artwork you submit to AWA regardless of form, (ii) visual/audio recordings or images of you or your Submitted Work; and (iii) your name and likeness, as well as any biographical material that you submit to AWA.
2. You agree that you grant the foregoing license without expectation of any royalty or other compensation of any kind from AWA.
3. You warrant and represent that each artwork that is part of the Submitted Work is an original work created by you, and that you own and have the right to license all rights in and to such artwork. You further warrant and represent that the Use of the Submitted Work (including your name, likeness, biographical material, or artwork) by AWA in accordance with this license will not infringe or violate the rights of any person.
4. You hereby release, discharge, and agree to indemnify and hold harmless AWA and its officers, directors, employees, and other agents from and against any and all claims, causes of action, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of the Use of the Submitted Work in accordance with this license.
AWA was one of the first organizations that approached me to join when I was starting out. I was thrilled to be showing with artists of their caliber.
